This page used to have a good article on it that was taken, with full attribution, from the Daily Maverick.
The Daily Maverick is a South African free-to-view collective blog made up to look like a newspaper.
The Daily Maverick people seem not to have liked the CU sampling their article. They went straight to Blogger with a complaint in terms of a US law, the Digital Millennium Copyright Act or "DMCA".
Blogger removed the item from the blog and set it back to be a draft. Then they sent me a long e-mail saying at the end:
"If it is brought to our attention that you have republished the post without removing the content/link in question, then we will delete your post and count it as a violation on your account. Repeated violations to our Terms of Service may result in further remedial action taken against your Blogger account including deleting your blog and/or terminating your account. If you have legal questions about this notification, you should retain your own legal counsel."
All this is a bit frightening for the Communist University. This is the first time in the history of the CU that it has happened. The only other time when there was a threat was from Tony Leon's lawyers during an election campaign, which we ignored, and which they had the good sense not to follow through with.
The Daily Maverick, in its message over our heads to Blogger, listed all of the material as being "in question" as a "copyright complaint". Hence I have removed all of it, including the link.

ReplyDeleteMalema has not been able to draw a crowd for the last six months at least (i.e. since the Party comrades booed him at Polokwane). It's time people realised how little support the man has. Empty vessels make the loudest noise. He is one of those. If you now look at how the Saturday Star treats this story, you will realise that the so-called "white media" is helping Malema, even while he abuses them. The Star does not say that the hall was nearly empty and that Malema had to wait for five hours for any kind of audience at all. The Star and other bourgeois media are building up Malema as a counterweight to the communists, and he is playing along with them. The Daily Maverick, which is a naive web site, even if it is bourgeois, has done like the boy in the story of the Emperor's clothes. It points out that Malema, the "populist", has no popular following. Malema only has a media cult behind him, thanks to the renegade Floyd. When that goes, as it must, there will be nothing left.
ReplyDeleteWhen you republish – without any attempt at requesting permission – the full text of a lengthy article as well as several accompanying pictures, that is not "sampling". It is a copyright violation. It also happens to be a violation not only of South African and American law, but of the terms of service you agreed to when you created this blog.
ReplyDeleteI'd highly recommend that you take a couple of minutes and learn the difference between sampling, fair use, and flagrant copyright violation.

Personally, I think you are just inexperienced or else you don't read an awful lot.
Please read what I wrote again. Nobody is going to challenge you. You applied the US DMCA law and you got your way. If those grapes turned out to be sour for you, then it's not me that is to blame. Nobody forced you to take that course.
Now: You go your way, and we'll go ours.
